1. Services

Rogue Alert is an ecommerce monitoring and alerting platform that makes certain features publicly available and may also offer beta, preview, early-access, or experimental features. Certain features, functionality, usage levels, integrations, and availability may be limited or unavailable depending on your subscription plan. Rogue Alert collects data from third-party services (including but not limited to Salesforce Commerce Cloud, Shopify, Google CrUX, and various vendor status pages) and presents it through a dashboard interface. Data made available by third parties may change, be rate-limited, be delayed, be incomplete, be suspended, or be unavailable, and we are not responsible for any such third-party data, systems, services, terms, rate limits, outages, changes, suspensions, or related consequences.

2. Account Access

Access to Rogue Alert requires an account. You are responsible for maintaining the confidentiality of your login credentials, restricting access to authorized users only, and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use or security incident affecting your account and to cooperate with reasonable remedial efforts.

3. Third-Party Credentials

To function, Rogue Alert requires API credentials for third-party services (e.g., SFCC client IDs, Shopify access tokens, Slack bot tokens). These credentials are encrypted at rest using AES-256-GCM. You are responsible for maintaining all required authorizations to provide these credentials and ensuring that their use complies with the applicable third-party's terms of service. Rogue Alert is not responsible for any consequences arising from the provision, use, suspension, revocation, expiration, or unavailability of such credentials.

4. Data Collection, Storage and Deletion

Rogue Alert collects and stores data from your connected services, including order data, site performance metrics, code version history, and sandbox usage, only as necessary to provide the service and in accordance with applicable data protection laws. This data is stored in isolated per-account databases and protected by reasonable administrative, technical, and organizational safeguards. We do not sell, share, or use your data for any purpose other than providing the service to you. You may request deletion of your account data; however, we may retain data for a commercially reasonable period for backup, security, audit, dispute resolution, and legal compliance purposes, and any retained data will be anonymized; cached or archived copies may persist consistent with our standard backup practices.

5. Monitoring Accuracy

Rogue Alert monitoring is informational only. While we strive for accuracy, we do not guarantee that alerts will be sent for every incident, that all outages will be detected, that notifications will be delivered or received, or that collected data is complete, timely, or error-free. You are responsible for verifying information and for your operational decisions, and you should not rely solely on Rogue Alert as your only monitoring solution.

6. Limitation of Liability and Hold Harmless

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROGUE ALERT AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, CUSTOMERS, OPPORTUNITIES, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROGUE ALERT'S AND ITS OPERATORS' TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNTS ACTUALLY PAID BY YOU TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You will defend, indemnify, and hold harmless Rogue Alert and its operators from and against any third-party claims, damages, liabilities, penalties, fines, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your data, (b) your use of the service (including any decisions or actions taken based on outputs), (c) your violation of these terms or applicable law, or (d) your violation of any third-party terms applicable to connected services or credentials; provided that Rogue Alert promptly notifies you of any such claim, you control the defense and settlement of the claim, Rogue Alert reasonably cooperates with you at your expense, and you may not settle any claim in a manner that imposes any obligation on, or includes any admission by, Rogue Alert without Rogue Alert's prior written consent.

7. Warranties and Disclaimers

Rogue Alert warrants that it will provide the Services in a professional and workmanlike manner consistent with generally accepted industry standards. Your sole and exclusive remedy for Rogue Alert's breach of this warranty will be, at Rogue Alert's option, re-performance of the affected Services or a refund of the fees paid by you for the affected Services during the period in which the breach occurred.

EXCEPT AS EXPRESSLY PROVIDED IN THIS SECTION, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROGUE ALERT DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, AND ERROR-FREE OR UNINTERRUPTED OPERATION.

Rogue Alert does not warrant that the Services will monitor every website, detect every change, provide complete or accurate information, operate without interruption, or meet your particular requirements. Rogue Alert does not control systems, networks, services, or infrastructure operated by vendors or other third parties and does not warrant that the Services will be free from interruptions, downtime, delays, or unavailability resulting from such systems, networks, services, or infrastructure. You acknowledge that information obtained from third-party websites may be delayed, incomplete, inaccurate, unavailable, or subject to change.

8. Beta Features

We may designate certain features, functionality, integrations, or services as beta, preview, early-access, experimental, or similar offerings (collectively, "Beta Features"). Beta Features may not be generally available, may contain bugs, experience downtime, undergo breaking changes, or result in loss or corruption of data. We may modify, suspend, or discontinue Beta Features at any time, with or without notice. You use Beta Features at your own risk and are responsible for maintaining appropriate backups and safeguards.

YOU ACKNOWLEDGE AND AGREE THAT BETA FEATURES ARE PROVIDED SOLELY ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS. ROGUE ALERT MAKES NO WARRANTIES, REPRESENTATIONS, CONDITIONS, OR GUARANTEES OF ANY KIND WITH RESPECT TO BETA FEATURES, AND ROGUE ALERT EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY WARRANTY THAT BETA FEATURES WILL BE PROVIDED IN A PROFESSIONAL OR WORKMANLIKE MANNER OR IN ACCORDANCE WITH ANY INDUSTRY STANDARD, AND ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AVAILABILITY, SECURITY, RELIABILITY, QUALITY, ERROR-FREE OR UNINTERRUPTED OPERATION, OR THAT DEFECTS WILL BE CORRECTED. YOUR ACCESS TO AND USE OF BETA FEATURES IS AT YOUR SOLE RISK.

9. Acceptable Use

You agree not to:

  • Use the service to monitor systems you do not own or have authorization to monitor
  • Attempt to access accounts or data belonging to other users
  • Use the service in any way that violates applicable laws or regulations
  • Reverse engineer, decompile, or attempt to extract the source code of the platform
  • Interfere with or disrupt the service, attempt to bypass or defeat security or access controls, probe or scan for vulnerabilities, or load test the service without our prior written consent
  • Use the service to store, transmit, or process unlawful, infringing, or malicious code or content, or to transmit spam or unsolicited messages
  • Access or use the service for purposes of developing or benchmarking a competing product or service, or to copy any features, functions, interfaces, or graphics of the service

A violation of these restrictions may result in suspension or termination of your access to Rogue Alert, without limiting any other remedies available to us under these terms or applicable law.

10. Intellectual Property; Feedback

We (and our licensors) retain all right, title, and interest in and to the service, including all software, technology, algorithms, templates, interfaces, and documentation, and all related intellectual property rights. If you provide suggestions, ideas, or feedback about the service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate the feedback without restriction or compensation.

11. Termination

We may immediately suspend, restrict, or terminate your access to Rogue Alert at any time, with or without cause, including when reasonably necessary to address security threats, misuse, legal or regulatory concerns, third-party service or credential issues, operational risks, or threats to Rogue Alert or other users.

12. Assignment

Rogue Alert may assign or transfer these Terms or the Service, in whole or in part, in connection with a merger, reorganization, sale of assets, or other corporate transaction. You may not assign or transfer any of your rights or obligations under these Terms without Rogue Alert's prior written consent.

13. Changes to Terms

We reserve the right to modify these terms at any time by posting an updated version (and updating the "Last updated" date). Material changes will be effective after reasonable notice to users, unless otherwise stated. Continued use of the service after the effective date constitutes acceptance of the modified terms. We may require affirmative acceptance of the modified terms as a condition of continued access to Rogue Alert.
